These Terms & Conditions ("Terms") govern your use of the Primal Signal field app and related services ("Service") provided by Michael Patrick Fitzhugh ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Account

You must be of legal age in your jurisdiction to purchase and use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it updated.

2. The Service

Primal Signal is a field-research application that provides environmental probability scoring, mapping, media capture, and submission tools for cryptid and wildlife field research. The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that data (weather, sighting, GPS) will be perfectly accurate.

3. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to: (a) any unlawful use; (b) fraud, spam, or harassment of other users; (c) infringing intellectual-property rights; (d) attempting to interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering); (e) reselling, sublicensing, or redistributing the Service without our written consent.

4. Intellectual Property

All software, artwork, audio, branding, and documentation that make up the Service are owned by Michael Patrick Fitzhugh or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal field-research use within the plan you purchased.

5. User Content

You retain ownership of the audio, photos, video, and notes you submit ("User Content"). You grant us a limited, worldwide license to host, store, process, and display your User Content solely to operate and improve the Service. You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right.

6. Payments & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer-service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms.

8. Suspension & Termination

We may suspend or terminate your access to the Service for: (a) material breach of these Terms; (b) non-payment; (c) suspected fraud or security risk; or (d) repeated or serious policy violations. On termination, your license to use the Service ends. You may request an export of your User Content within 30 days of termination, after which it may be deleted.

9. Disclaimers

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. The Service is a research aid; it is not a safety, emergency, navigation, or survival device. Do not rely on it as your sole information source in the field.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

11. Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your User Content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State in which Michael Patrick Fitzhugh resides (United States), without regard to conflict-of-laws principles. The state and federal courts located there shall have exclusive jurisdiction over any dispute.
